General Terms and Conditions

These General Terms and Conditions (“Terms”) govern access to and use of the online booking platform branded as Farm in Tuscany (“Platform”), operated by SAB di Seif Allah Bibari with registered office at Viale Spartaco Lavagnini 70/72, 50129 Florence, Italy, VAT number IT07456810485 (“Farm in Tuscany,” “we,” “us,” or “our”).

The Platform is accessible through the website www.farmintuscany.com.

These Terms, together with the Cookies & Privacy Policy, regulate the use of the Platform and the booking of experiences, tours, workshops, and activities offered either by independent local providers identified as “Local Partners” or, where specified, directly by Farm in Tuscany.

By accessing, browsing, or making a booking through the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms.

If you do not accept these Terms, you must refrain from using the Platform.

1. Our Role and Structure

Farm in Tuscany operates under different service models depending on the Experience selected.

Marketplace Model
For certain Experiences, Farm in Tuscany acts solely as an intermediary connecting customers with independent local providers referred to as “Local Partners.” The Local Partner is clearly identified on the Experience page under “Hosted and guided by.” In these cases, the contract for the delivery of the Experience is directly between you and the Local Partner. Farm in Tuscany facilitates booking, payment processing, and customer assistance.

Coordinated Experience Model
Some Experiences include multiple services such as farms, guides, artisans, or transportation providers. In these cases, Farm in Tuscany coordinates the services of independent Local Partners. Each Local Partner remains fully responsible for the service it provides.

Curated or Combined Experiences
Certain Experiences are designed and assembled by Farm in Tuscany as a combined offering. In such cases, Farm in Tuscany acts as the contracting party for the overall Experience, while specific components may be delivered by independent Local Partners.

The applicable structure is determined by the description on the relevant Experience page.

2. Transport Services

Where transportation is provided directly by Farm in Tuscany using its own vehicles, Farm in Tuscany is responsible for that specific transport service in accordance with applicable law.

Where transportation is provided by a Local Partner, that Local Partner is solely responsible for the transport service.

3. Booking and Confirmation

A booking becomes valid only upon receipt of a confirmation email.

You are responsible for reviewing all details immediately after confirmation.

Farm in Tuscany reserves the right to refuse or cancel a booking in cases of pricing errors, availability errors, or suspected fraudulent activity.

4. Pricing and Payments

All prices are displayed in Euro and include applicable taxes unless otherwise specified.

Optional services or add ons are clearly shown before checkout.

Payments are processed on behalf of SAB di Seif Allah Bibari through secure third party payment providers, including Stripe.

SAB di Seif Allah Bibari is the merchant of record for all transactions.

By submitting payment information, you authorize SAB di Seif Allah Bibari to charge the total amount due for the booking via its designated payment processors.

Payment processing services are subject to the terms and privacy policies of the relevant payment provider.

SAB di Seif Allah Bibari does not store full credit card details and is not responsible for errors, security breaches, or service interruptions attributable to third party payment processors.

5. Cancellation and Refund Policy

Cancellation terms vary by Experience and are clearly stated on each Experience page.

By completing a booking, you accept the specific cancellation policy applicable to that Experience.

Refund eligibility is determined exclusively by the cancellation conditions presented at the time of booking.

If an Experience is cancelled by the Local Partner or by Farm in Tuscany due to safety concerns, weather conditions, or other unforeseen circumstances, you will be offered rescheduling or a full refund.

Refunds are processed using the original payment method.

6. Promotional Codes and Discounts

Farm in Tuscany may issue promotional codes, discount codes, or special offers at its sole discretion.

Promotional codes:

• Are valid only for the period specified at the time of issuance
• Apply only to eligible Experiences as indicated
• Must be applied at the time of booking and cannot be applied retroactively
• Cannot be combined with other promotions unless expressly stated
• Have no cash value and are non transferable
• May not be resold, reproduced, or distributed without authorization

Farm in Tuscany reserves the right to refuse, cancel, or adjust any booking where a promotional code has been applied incorrectly, fraudulently, or in breach of these Terms.

Where promotional codes are issued to travel advisors or professional partners, their use is subject to any separate commercial agreement in place. Misuse may result in suspension of access or termination of partnership.

7. Gift Purchases

Certain Experiences may be purchased as a gift for another person (“Recipient”).

When purchasing a gift, you must provide accurate Recipient details as requested during checkout. You are responsible for ensuring that the Recipient information is correct.

Changes to Recipient details may be requested by contacting Farm in Tuscany. Approval is subject to operational feasibility and may require verification of the purchaser.

A gifted Experience is redeemable only for the specific Experience booked and is valid only for the scheduled date and time of execution, unless otherwise stated on the Experience page or agreed in writing by Farm in Tuscany.

Gift purchases are subject to the same cancellation and refund policy applicable to the booked Experience.

Farm in Tuscany is not responsible for a Recipient’s inability to participate due to failure to meet participation requirements or failure to attend.

8. Changes and Modifications

For Experiences delivered by a Local Partner, the Local Partner retains authority to reschedule or modify elements of the Experience for operational or safety reasons.

Minor adjustments to timing, meeting points, routes, or itinerary may be made by the Local Partner or, where applicable, by Farm in Tuscany for operational or safety reasons.

 

In the event of material changes, you may accept the revised arrangement or request a refund where applicable.

 

Farm in Tuscany does not guarantee uninterrupted availability of any Experience.

9. Arrival, Participation, and Conduct

You are responsible for arriving at the meeting point on time.

 

Late arrival or failure to attend may result in loss of the booking without refund, subject to the applicable cancellation policy.

 

Participation requirements, including age, health conditions, and safety restrictions, are stated on each Experience page.

 

By booking, you confirm that all participants meet the stated requirements and agree to follow all safety instructions provided by Farm in Tuscany or the Local Partner.

 

Some Experiences may involve inherent risks. By participating, you acknowledge and accept such risks to the extent permitted by law.

10. Independent Contractors

Local Partners, including farms, guides, artisans, drivers, and transportation providers, operate as independent contractors.

Except where expressly stated that Farm in Tuscany acts as the contracting party for a specific combined Experience, Local Partners are solely responsible for the delivery of their services.

Nothing in these Terms creates a partnership, employment relationship, joint venture, or agency relationship between Farm in Tuscany and any Local Partner.

11. Insurance

Local Partners are responsible for maintaining all legally required licenses and insurance for the services they provide.

 

Where Farm in Tuscany directly provides transport services, it maintains insurance coverage as required by applicable law.

12. Liability

For Experiences delivered under the Marketplace Model, the Local Partner is solely responsible for the execution of the Experience.

For Curated or Combined Experiences where Farm in Tuscany acts as the contracting party, Farm in Tuscany is responsible for the overall organization of the Experience, subject to the limitations set out in these Terms.

To the maximum extent permitted by law, Farm in Tuscany shall not be liable for indirect or consequential damages, including loss of enjoyment, loss of profits, or travel related expenses not directly linked to the booked Experience.

To the maximum extent permitted by law, the total liability of Farm in Tuscany arising out of or in connection with any booking shall not exceed the total amount paid for the specific Experience.

Nothing in these Terms excludes liability where exclusion is not permitted by law.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or for any other liability that cannot be limited or excluded under applicable law.

13. Force Majeure

Neither Farm in Tuscany nor any Local Partner shall be liable for cancellations, delays, or modifications caused by events beyond reasonable control, including but not limited to severe weather, natural disasters, strikes, governmental restrictions, or other force majeure events.

14. Professional and B2B Bookings

If a booking is made by a travel advisor, agency, or other professional on behalf of clients, the professional confirms that:

They are authorized to accept these Terms on behalf of their clients.

They are responsible for communicating all Experience details, requirements, and cancellation conditions to their clients.

Any commission or commercial agreement is governed by separate written arrangements.

Farm in Tuscany’s liability remains limited as stated in these Terms.

15. Intellectual Property

All website content, including text, images, branding, and design elements, remains the property of Farm in Tuscany or its licensors.

Unauthorized use, reproduction, or distribution is prohibited.

16. Privacy

Personal data is processed in accordance with applicable data protection laws, including the GDPR.

17. Amendments

Farm in Tuscany reserves the right to modify these Terms at any time. Updated versions will be published on the Platform with a revised “Last Update” date. Continued use of the Platform after publication constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Governing Law and Jurisdiction

These Terms are governed by Italian law.

Any disputes shall be subject to the jurisdiction of the courts of Florence, unless mandatory consumer protection laws provide otherwise.
